Booking & Cancellation Terms
Terms for bookings made through our website or directly with the host: requests, confirmation, payment, cancellation, changes and your stay.
Last updated: 16 October 2026
1. Scope and parties
These terms apply to accommodation bookings made through the hesperasuits.com website or directly with the host by WhatsApp, email or phone. The accommodation is provided by İrfan (“the Host”); address: Ormancılar Sitesi, Kadıkalesi, Karakaya Mah., 48960 Bodrum / Muğla, Türkiye, email: yyasinyilmaz0@gmail.com, phone: , tourism rental registration no.: 48-13627. The person making the booking and everyone staying with them are referred to as “the Guest”.
Bookings made through third-party platforms such as Airbnb are governed by that platform’s own terms and cancellation policy. These terms then apply only to matters not covered by the platform’s terms and with regard to our House Rules.
2. Booking request and confirmation
- A request sent through the website’s booking form or by direct message is a request only. On its own it is not binding and does not reserve any dates.
- The Host reviews the request and sends the Guest a written confirmation by email or WhatsApp. The confirmation states the home, dates, number of guests, total price, what is included, the payment terms and any special arrangements.
- The booking becomes binding once the Guest pays the deposit stated in the confirmation within the stated deadline. If the deposit is not received in time, the Host may release the dates.
3. Prices
Prices shown on the website are indicative and may change until a booking is confirmed. The price that applies is the total stated in the written confirmation. Once a confirmation has been sent, the price will not change except as a result of changes requested by the Guest.
4. Payment
- The deposit, the balance and its due date, and the payment method (for example bank transfer) are set out in the confirmation.
- Unless agreed otherwise, bank and currency-conversion charges are borne by the sender.
- If the balance is not paid by the date in the confirmation, the Host may, after notifying the Guest in writing, treat the booking as cancelled by the Guest, in which case the cancellation terms below apply.
- Receipts for payments and refunds are provided on request.
5. Cancellation by the Guest
Unless otherwise agreed in writing in your confirmation, the following cancellation terms apply. Periods are counted back from the day of arrival, based on the date the Host receives your written cancellation:
- Cancellation 14 days or more before arrival: full refund of the amount paid.
- Cancellation between 14 and 7 days before arrival: 50% refund. The Host retains 50% of the total price of the stay and refunds any amount paid above that; if the stay was paid in full, this means half of the amount paid is refunded.
- Cancellation less than 7 days before arrival: no refund of the amount paid.
Refunds are made within 14 days of the cancellation notice, by the original payment method or another method agreed between the parties. If the cancelled dates can be re-let to another guest, the Host may, at their discretion, make an additional refund.
As these contracts concern accommodation services provided on specific dates, there is no statutory right of withdrawal under Article 15 of the Turkish Distance Contracts Regulation; the cancellation terms above apply instead.
6. Cancellation by the Host
If the Host cancels a booking or cannot provide the home for reasons not attributable to the Guest, everything the Guest has paid will be refunded without delay. Where possible, the Host will try to offer an equivalent alternative; the Guest is under no obligation to accept it.
7. Changes
Requests to change dates, the home or the number of guests must be made in writing and are subject to availability. Any change agreed will be confirmed in writing, together with any difference in price. Unless agreed otherwise, shortening a stay, or postponing dates less than 14 days before arrival, counts as a cancellation of the part affected.
8. No-shows and early departure
If the Guest does not arrive by 12:00 on the day after the arrival date without letting the Host know, the booking is treated as cancelled less than 7 days before arrival. If the Guest chooses to leave early, there is no refund for unused nights unless agreed otherwise in writing.
9. Check-in, check-out and guest numbers
- Check-in is from 15:00 and check-out is at 11:00. Late check-out is possible only with the Host’s agreement.
- The number of people staying may not exceed the number of guests in the confirmation or the maximum capacity of the home. Additional people may not stay without the Host’s consent.
- If this rule is breached, the Host may refuse to accommodate the additional people or end the stay without refund.
10. Identification
Under Turkish Law No. 1774 on Identity Notification and related legislation, the identity details of all guests must be registered with the competent authorities. Every guest, including children, must therefore present a valid ID card or passport at or before check-in. If identification is not provided, the Host may refuse check-in, which will be treated as a cancellation by the Guest. Personal data is handled in line with our Privacy Notice.
11. Damage and security deposit
The Guest must take good care of the home and its contents and is responsible for loss or damage beyond normal wear and tear. Any damage should be reported to the Host straight away.
The Host may ask for a security deposit, provided this is stated in the confirmation together with its amount, payment method and refund period. If no damage or missing items are found at check-out, the deposit is returned within the period stated in the confirmation; the documented cost of any damage may be deducted.
12. Pets
Pets are welcome, provided their kind and number are declared when booking and included in the confirmation. Owners are responsible for any damage or disturbance caused by their pets and must follow the House Rules and the complex’s rules in shared areas.
13. House Rules and the complex
Our House Rules form an integral part of these terms. Guests must also follow the rules of the Ormancılar complex for its shared areas and beach. In the event of a serious or repeated breach of the House Rules—such as holding a party, unauthorised additional guests or behaviour that seriously disturbs neighbours—that continues despite a written warning, the Host may end the stay without refund.
14. Liability
The Host undertakes to provide the home clean and ready for use on the confirmed dates. The Host is not liable for short interruptions to utilities outside their control, such as electricity, water or internet, but will make reasonable efforts to help. To the extent permitted by law, personal belongings left in the home and use of the beach, garden and shared areas are at the Guest’s own risk. Nothing in these terms limits the Host’s liability for intent or gross negligence.
15. Force majeure
Neither party is liable for failing to perform its obligations where a stay cannot take place because of events beyond their control that could not reasonably be foreseen, such as natural disasters, epidemics, war, fire or travel or accommodation restrictions imposed by the authorities. In that case, the parties will first try in good faith to agree on new dates; if they cannot, amounts paid for services that cannot be provided will be refunded.
16. Notices
Notices under these terms are given in writing to the email address or WhatsApp number used by each party for the booking.
17. Governing law and disputes
These terms are governed by the laws of the Republic of Turkey. Guests acting as consumers may refer disputes to the Consumer Arbitration Committee (Tüketici Hakem Heyeti) at their place of residence or where the transaction took place, within the monetary limits announced each year by the Ministry of Trade, and to the consumer courts above those limits. Otherwise, the courts and enforcement offices of Bodrum have jurisdiction. This does not limit any mandatory consumer protection rights you may have under the law of your country of residence.
